Terms of Use

These Terms govern the use of Care About Us Fund, a fundraising platform operated by Care About Us Fund. By creating an account, publishing a fundraiser or making a donation, you agree to them. If you do not agree, do not use the platform.

1. Who we are

The platform is operated by Care About Us Fund. The registered name, registration number and address of the entity will appear in this section once incorporation is complete.

We are not a bank, a broker or a financial adviser. We are the platform where organisers publish fundraisers and donors contribute. Payments are processed by third-party providers.

2. Who may use it

You must be 18 or older and have full legal capacity to create an account, publish a fundraiser or withdraw funds. Donating does not require an account, but requires the same minimum age.

A fundraiser may benefit a minor, provided the organiser is their legal guardian and identifies themselves as such. We may ask for proof at any time.

You may not use the platform if you are in a country, on a list, or under a sanctions regime applicable to Care About Us Fund or to our payment providers.

3. What the platform does — and does not do

We are not a party to the relationship between donor and organiser. A donation is made at your own risk: we host the page, process the payment and pass it to the beneficiary, but we are not jointly liable for delivering what a fundraiser promises.

We do not endorse any fundraiser. Appearing on the platform, passing review, or carrying a verified-identity badge is not a recommendation from us and not a guarantee that the money will be used as described.

We do not guarantee that anything will be raised. No fundraiser is promised its goal, any traffic, or a place in a featured list.

The human review and risk engine described on the security page reduce fraud without eliminating it. We describe honestly what we do; we do not promise an outcome.

4. Your account

You are responsible for keeping your password secret and for everything that happens in your account. Tell us immediately if it is accessed without your authorisation.

The information you give us must be true and current. We may suspend an account holding false information.

Do not share credentials, and do not create an account in someone else's name without their express authorisation.

5. Publishing a fundraiser

By publishing, you state that: the cause is real; you are entitled to raise money on the beneficiary's behalf; and the money will be used for the purpose described.

If the fundraiser is for someone else, you need their consent. We may ask for proof of it and hold funds until we have it.

Every fundraiser is reviewed before it becomes public. We may refuse it, ask for changes, or block it at any time, with or without prior notice, where there is any sign these Terms have been broken.

A material change of purpose after publication must be communicated to donors through the fundraiser's own updates page. Changing the purpose without saying so is grounds for blocking and refunds.

6. Donations, fees and what happens to the money

A donation is a gift, not a purchase. Nothing is delivered in exchange, and so as a rule there is no cooling-off right and no automatic refund.

Current fees are always on the fees page, and the amount is shown before you confirm. The fee that applies is the one in force at the moment of the donation, and it does not change afterwards.

Confirmed donations are held for a window described on the fees page before they can be withdrawn. During that window a donor can ask support to cancel.

We may hold, block or reverse funds, on reasoned grounds, where: fraud is suspected; the fundraiser breaks these Terms; we cannot confirm the beneficiary's consent; a competent authority orders it; or the card network or processor requires it.

We are not responsible for indirect consequences of a hold or reversal, such as bank charges or commitments an organiser made counting on the money.

7. Balance and withdrawals

The balance shown in your wallet is an amount recorded as owed to you by Care About Us Fund, derived from our ledger. It is not a bank deposit and it is not a third-party payment account.

Withdrawals are sent to the payout details you provide, and their ownership and accuracy are your responsibility. A payment sent to incorrect details you supplied is not refundable by us.

We may condition a withdrawal on identity verification, and may hold it while an investigation is open, while the balance is negative from a chargeback, or while documents are outstanding.

8. Payment disputes (chargebacks)

If a donor disputes a charge with their card issuer and the dispute succeeds, the money is returned to them and debited from the beneficiary, including when it has already been withdrawn — in which case the balance goes negative until future donations offset it.

Because a donation involves no goods, we may contest chargebacks raised on the grounds that an item was not received.

9. Content you publish

You keep ownership of the text, photographs and video you publish. By publishing them you grant Care About Us Fund a non-exclusive, worldwide, royalty-free licence to display, reproduce, reformat and translate that content, solely to operate and promote the platform and your fundraiser.

Machine translations are labelled as such and keep a link to the original. We are not responsible for inaccuracy in a machine translation.

You confirm you hold the rights to what you publish, including permission from people shown in images.

10. Prohibited use

The full list of prohibited fundraisers and conduct is on the Acceptable Use page, which forms part of these Terms.

A breach allows us, without prior notice, to: remove content, block the fundraiser, suspend the account, hold and reverse funds, and report to the authorities where appropriate.

11. Suspension and closure

We may suspend or close your account where these Terms are broken, where there is a risk to the community, where the law requires it, or where a payment provider directs it.

You may close your account at any time from the My data page. Closure is scheduled 30 days ahead — time in which you can withdraw your balance and close fundraisers — and can be cancelled during that period.

Once the account is closed, financial records remain for the period the law requires, as described in the Privacy Policy. The ledger is immutable.

12. Warranties and limitation of liability

The platform is provided as is. We do not warrant uninterrupted operation, freedom from errors, or that the platform suits any particular purpose.

To the fullest extent the applicable law allows, Care About Us Fund is not liable for indirect damages, lost profits, lost data or non-material damages arising from use of the platform.

Nothing in these Terms removes rights that the applicable law treats as ones a consumer cannot waive.

13. Indemnity

You agree to hold Care About Us Fund harmless from third-party claims arising from content you published, a fundraiser you organised, misuse of the money raised, or a breach of these Terms.

14. Changes

We may change these Terms. A material change is announced with reasonable notice by e-mail or on the platform, and takes effect on the date given.

Every version has a number and a date. We keep a record of which version you accepted and when.

15. Governing law and forum

These Terms are governed by the laws of the State of Delaware, United States, without prejudice to consumer-protection and data-protection rules applicable in the user's country of residence.

The courts of the State of Delaware are chosen as the forum, without prejudice to a consumer's right to sue where they live when the law grants it.
